In this section, you can find information about Kahwanake online gambling legislation, requirements for a casino license, information about gambling taxes, dispute resolution process and where to address the player complaints.
Kahnawake is the name of a community and a location. It is located on the south shore of the St. Lawrence River, 20 minutes from Montréal, Canada. It covers only 20 miles, with a population of 8.000 Mohawks (North American Indians). This is a historic location for the Indians, where many battles have been fought. Kahnawake is one of the world’s first online gambling jurisdictions, they are issuing licenses since 1996.
Kahnawake Gaming Commission (KGC) deals with the gambling and betting licenses. Their website is at https://www.gamingcommission.ca address. KGC was first established in 1996 and its legality is based on the aboriginal rights. They are recognized by the Canada’s Constitution Act, and they have their own laws and regulations. There is no government in the jurisdiction, only a Council of the Elders. The goal of the KGC is “to license and regulate gaming and gaming related activities conducted within and from the Mohawk Territory of Kahnawake in accordance with the highest principles of honesty and integrity.” KGC consists of three members, and they are appointed by the Council.
Only legislation about electronic gambling is called Kahnawake Gaming Law. This link also explains nearly all of the regulations required for the electronic gambling. Currently, there are 50 online gaming operators and 250 online gaming sites licensed by the KGC. You can see a list of these companies & sites from these addresses: https://www.gamingcommission.ca/interactiveOp.htm & https://www.gamingcommission.ca/interactiveURL.htm
There are four types of licenses issued by the KGC, and these are: Interactive Gaming License (IGC), Client Provider Authorization (CPA), Secondary Client Provider Authorization (Secondary CPA), and Key Person License (KPL). You must deposit a total of 10.000 USD before an application will be processed. An investigation is issued which takes around 4-8 weeks. During this time, the applicant is tested by independent houses such as eCOGRA, Technical Systems Testing, iTech Labs and Gaming Associates.
If all goes well, a total of 40.000 USD is needed for a preliminary 12-month permit. These permits (licenses) must be renewed each year.
You can check these links for the full details of the process:
There are no taxes in any form for the gambling companies.
Kahwanake is a tax-free jurisdiction, you don’t need to pay any gambling taxes for your winnings.
Online casinos in Kahwanake must provide a way of self-exclusion and limitations on deposits, bets, play sessions and losses to get a license. Even a family member can address the KGC and ask for limitations for a player.
All limitation claims must be addressed to the licensee (online casino) in a written form. If you are a family member of a player, you must address these claims to KGC. E-mail claims are acceptable.
All player complaints must be addressed to KGC in written form. You can use the mailing address, fax number or email address of the Commission. Their postal address is Kahnawake Gaming Commission, P.O. Box 1799, Old Malone Highway, Kahnawake Mohawk Territory, QC J0L 1B0, CANADA. Their e-mail is email@example.com. You can also call and fax them on +1 450 635 1076 and +1 450 635 1139.
You can also use the form located in https://www.gamingcommission.ca/feedback.asp address. Details of the dispute resolution process are unknown. But the decision of the KGC is final and you can appeal only by Canadian courts.
